2. Use of Service

gigz.top provides a platform that connects individuals or businesses seeking services ("Clients") with individuals or businesses offering services ("Freelancers") for short-term engagements or "gigs."

2.1 Eligibility

To use the Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Possess the legal authority to enter into binding contracts.
• Provide accurate, current, and complete information during registration and maintain the accuracy of such information.
• Not be barred from receiving services under applicable law.

2.2 Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2.3 Service Scope and Modifications

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purposes. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content.

3. User Responsibilities

All users of the Service agree to the following responsibilities:

3.1 General Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To engage in any fraudulent, deceptive, or misleading activity.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate gigz.top, a gigz.top employee, another user, or any other person or entity.
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm gigz.top or users of the Service.

3.2 Client Responsibilities

• Provide clear, accurate, and complete descriptions for gigs.
• Communicate professionally and respectfully with Freelancers.
• Pay for services rendered in accordance with the agreed terms and gigz.top's payment processing system.
• Comply with all applicable laws regarding employment, independent contractor relationships, and payment for services.

3.3 Freelancer Responsibilities

• Provide accurate information regarding skills, experience, and qualifications.
• Perform gigs with professionalism, diligence, and in accordance with the Client's specifications and agreed timelines.
• Communicate professionally and respectfully with Clients.
• Comply with all applicable laws, including tax obligations, related to income earned through the platform.
• Refrain from soliciting Clients for work outside the gigz.top platform to circumvent fees.

3.4 Transactions and Disputes

gigz.top acts solely as a platform to facilitate connections. The contract for service is directly between the Client and the Freelancer. gigz.top is not a party to any agreement between users. Users are solely responsible for negotiating the terms of their engagement, deliverables, and timelines. While we may offer dispute resolution tools, gigz.top has no obligation to resolve disputes between users and is not liable for any claims arising from the service provided or received.

4. Intellectual Property

4.1 Platform Intellectual Property

The Service and its original content, features, functionality, design, logos, trademarks, and source code are owned by gigz.top and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works of, publicly display, or reverse engineer any part of the Service without our express prior written consent.

4.2 User-Generated Content

By posting, submitting, or displaying content (including gig descriptions, proposals, messages, reviews, and deliverables) on or through the Service, you grant gigz.top a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display such content solely for the purpose of operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

Work product created by a Freelancer and delivered to a Client ("Work Product") is governed by the agreement between those users. Unless otherwise agreed in writing, upon full payment by the Client, the Freelancer assigns all rights, title, and interest in the Work Product to the Client.

5. Limitation of Liability and Disclaimers

5.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. gigz.top DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL gigz.top, ITS DIRECTORS, EMPLOYEES, PARTNERS
